1. Introduction

V4Masters Courier Aggregator is a technology platform operated by V4 Masters E Vyapari that enables Vendors to book, manage, track and process shipments through multiple third-party courier partners.

The services are available exclusively through ship.v4masters.com.

By registering, creating an account, booking shipments or using any service provided through the Platform, the Vendor agrees to be bound by these Terms & Conditions.

V4Masters Courier Aggregator, V4 Masters E Vyapari द्वारा संचालित एक प्रौद्योगिकी आधारित प्लेटफ़ॉर्म है, जो Vendors को विभिन्न तृतीय-पक्ष कूरियर पार्टनर्स के माध्यम से शिपमेंट बुक, प्रबंधित, ट्रैक एवं प्रोसेस करने की सुविधा प्रदान करता है।

यह सेवाएँ केवल ship.v4masters.com पर उपलब्ध हैं।

प्लेटफ़ॉर्म पर पंजीकरण करने, खाता बनाने, शिपमेंट बुक करने अथवा किसी भी सेवा का उपयोग करने पर Vendor इन नियमों एवं शर्तों से बाध्य होने के लिए सहमत होता है।

2. Definitions

  • Platform means the website ship.v4masters.com operated by V4 Masters E Vyapari.
  • Vendor means any person, proprietorship, firm, company or legal entity registered on the Platform.
  • Courier Partner means any third-party logistics or courier company integrated with the Platform.
  • Shipment means any parcel, package or consignment booked through the Platform.
  • Claim means a request for compensation for loss or damage to a shipment.

  • Platform से तात्पर्य V4 Masters E Vyapari द्वारा संचालित वेबसाइट ship.v4masters.com से है।
  • Vendor से तात्पर्य किसी भी व्यक्ति, प्रोप्राइटरशिप, फर्म, कंपनी या कानूनी संस्था से है जो Platform पर पंजीकृत हो।
  • Courier Partner से तात्पर्य Platform से जुड़े किसी तृतीय-पक्ष लॉजिस्टिक्स या कूरियर प्रदाता से है।
  • Shipment से तात्पर्य Platform के माध्यम से बुक किया गया कोई भी पार्सल या कंसाइनमेंट है।
  • Claim से तात्पर्य खोए या क्षतिग्रस्त शिपमेंट के लिए किए गए दावे से है।

3. Vendor Eligibility

3. विक्रेता पात्रता

English

To use the Platform, a Vendor must:

  • Be at least 18 years of age;
  • Be legally capable of entering into a binding contract;
  • Provide accurate registration details;
  • Possess valid identity and banking documents;
  • Comply with all applicable laws and regulations.

V4 Masters E Vyapari reserves the right to approve, reject, suspend or terminate any Vendor account at its sole discretion.

Platform का उपयोग करने के लिए Vendor:

  • कम से कम 18 वर्ष का होना चाहिए;
  • वैध अनुबंध करने में सक्षम होना चाहिए;
  • सही पंजीकरण जानकारी प्रदान करनी चाहिए;
  • वैध पहचान एवं बैंकिंग दस्तावेज रखने चाहिए;
  • सभी लागू कानूनों एवं नियमों का पालन करना चाहिए।

V4 Masters E Vyapari किसी भी Vendor Account को अपने विवेकानुसार स्वीकृत, अस्वीकृत, निलंबित या समाप्त करने का अधिकार सुरक्षित रखता है।

4. Account Registration & Verification

4. खाता पंजीकरण एवं सत्यापन

The Vendor may be required to submit:

  • PAN Card;
  • Aadhaar Card or Government Identity Proof;
  • Bank Account Proof or Cancelled Cheque;
  • Address Proof;
  • Mobile Verification;
  • Email Verification;
  • GST Registration (if applicable);
  • Other documents as requested by the Platform.

The Vendor confirms that all information submitted is true, complete and accurate.

Providing false or misleading information may result in suspension or termination of the account.

Vendor को निम्न दस्तावेज प्रस्तुत करने पड़ सकते हैं:

  • PAN Card;
  • Aadhaar Card या सरकारी पहचान पत्र;
  • Bank Account Proof या Cancelled Cheque;
  • Address Proof;
  • Mobile Verification;
  • Email Verification;
  • GST Registration (यदि लागू हो);
  • Platform द्वारा मांगे गए अन्य दस्तावेज।

Vendor यह पुष्टि करता है कि उसके द्वारा दी गई सभी जानकारी सही, पूर्ण और सत्य है।

गलत या भ्रामक जानकारी देने पर Account निलंबित या समाप्त किया जा सकता है।

5. Platform Usage

5. प्लेटफ़ॉर्म का उपयोग

English

The Vendor shall use the Platform only for lawful purposes.

The Vendor agrees not to:

  • Misuse the Platform;
  • Attempt unauthorized access;
  • Interfere with Platform operations;
  • Upload malicious software;
  • Use the Platform for illegal shipments;
  • Violate applicable laws or courier partner policies.

Vendor Platform का उपयोग केवल वैध उद्देश्यों के लिए करेगा।

Vendor निम्न कार्य नहीं करेगा:

  • Platform का दुरुपयोग;
  • अनधिकृत पहुँच प्राप्त करने का प्रयास;
  • Platform की सेवाओं में बाधा उत्पन्न करना;
  • दुर्भावनापूर्ण सॉफ्टवेयर अपलोड करना;
  • अवैध शिपमेंट करना;
  • लागू कानूनों या Courier Partner की नीतियों का उल्लंघन करना।

6. Vendor Responsibilities

6. विक्रेता की जिम्मेदारियाँ

English

The Vendor agrees that:

  • All information provided to the Platform is true, complete and accurate.
  • All shipments booked through the Platform are lawful and authorized.
  • Packaging shall be secure and suitable for transportation.
  • Shipment details, weight, dimensions and product descriptions shall be entered correctly.
  • Customer details and delivery addresses shall be accurate.
  • All invoices and documents submitted shall be genuine and valid.

The Vendor shall be solely responsible for any loss, penalty, claim or damage arising from:

  • Incorrect information;
  • Improper packaging;
  • Wrong declaration of weight or dimensions;
  • Shipment of prohibited goods;
  • Non-compliance with applicable laws.

Vendor सहमत है कि:

  • Platform को प्रदान की गई सभी जानकारी सही, पूर्ण एवं सत्य होगी।
  • Platform के माध्यम से बुक किए गए सभी शिपमेंट वैध एवं अधिकृत होंगे।
  • पैकेजिंग सुरक्षित एवं परिवहन योग्य होगी।
  • Shipment का Weight, Dimension एवं विवरण सही दर्ज किया जाएगा।
  • Customer एवं Delivery Address की जानकारी सही होगी।
  • सभी Invoice एवं दस्तावेज वास्तविक एवं वैध होंगे।

निम्न कारणों से उत्पन्न किसी भी हानि, दंड, दावे या क्षति के लिए Vendor स्वयं जिम्मेदार होगा:

  • गलत जानकारी;
  • खराब पैकेजिंग;
  • गलत Weight या Dimension घोषित करना;
  • प्रतिबंधित वस्तुओं की शिपिंग;
  • लागू कानूनों का उल्लंघन।

7. Prohibited Activities

7. प्रतिबंधित गतिविधियाँ

The Vendor shall not:

  • Ship any prohibited or illegal items;
  • Upload false or misleading information;
  • Manipulate shipment weight or dimensions;
  • Misuse the Platform or courier partner systems;
  • Attempt unauthorized access to Platform systems;
  • Interfere with Platform operations;
  • Use bots, malicious software or automated scripts;
  • Engage in fraudulent activities.

V4 Masters E Vyapari reserves the right to suspend or terminate any Vendor account involved in prohibited activities.

Vendor निम्न कार्य नहीं करेगा:

  • प्रतिबंधित या अवैध वस्तुओं की शिपिंग;
  • गलत या भ्रामक जानकारी देना;
  • Weight या Dimension में हेरफेर करना;
  • Platform या Courier Partner की सेवाओं का दुरुपयोग करना;
  • Platform में अनधिकृत प्रवेश का प्रयास करना;
  • Platform के संचालन में बाधा उत्पन्न करना;
  • Bot, Malware या Automated Script का उपयोग करना;
  • धोखाधड़ीपूर्ण गतिविधियों में शामिल होना।

ऐसी गतिविधियों में शामिल पाए जाने पर V4 Masters E Vyapari संबंधित Vendor Account को निलंबित या समाप्त कर सकता है।

8. Payments & Billing

8. भुगतान एवं बिलिंग

English

The Vendor agrees to pay all applicable charges, including but not limited to:

  • Shipping Charges;
  • COD Charges;
  • RTO Charges;
  • Fuel Surcharge;
  • Remote Area Charges;
  • Volumetric Weight Charges;
  • Reweighment Charges;
  • Taxes and statutory levies;
  • Other applicable charges.

The Platform reserves the right to:

  • Debit Vendor Wallet;
  • Adjust outstanding dues;
  • Recover additional charges;
  • Hold shipments or suspend services in case of unpaid dues.

Failure to pay dues may result in account suspension or termination.

Vendor निम्न सभी लागू शुल्कों का भुगतान करने के लिए सहमत होगा:

  • Shipping Charges;
  • COD Charges;
  • RTO Charges;
  • Fuel Surcharge;
  • Remote Area Charges;
  • Volumetric Weight Charges;
  • Reweighment Charges;
  • Taxes एवं वैधानिक शुल्क;
  • अन्य लागू शुल्क।

Platform को यह अधिकार होगा कि वह:

  • Vendor Wallet से राशि डेबिट करे;
  • बकाया राशि समायोजित करे;
  • अतिरिक्त शुल्क वसूल करे;
  • भुगतान न होने की स्थिति में शिपमेंट या सेवाएँ रोक दे।

भुगतान न करने की स्थिति में Account निलंबित या समाप्त किया जा सकता है।

9. Intellectual Property Rights

9. बौद्धिक संपदा अधिकार

All trademarks, logos, trade names, software, website content, designs and intellectual property associated with:

ship.v4masters.com

are the exclusive property of V4 Masters E Vyapari.

The Vendor shall not:

  • Copy or reproduce Platform content;
  • Use Platform logos without permission;
  • Register confusingly similar names, domains or trademarks;
  • Modify, reverse engineer or exploit Platform software;
  • Claim ownership over any intellectual property of the Platform.

Unauthorized use may result in:

  • Suspension of account;
  • Legal action;
  • Claim for damages;
  • Permanent termination of services.

निम्न से संबंधित सभी ट्रेडमार्क, लोगो, व्यापारिक नाम, सॉफ्टवेयर, वेबसाइट सामग्री, डिज़ाइन एवं बौद्धिक संपदा:

तथा

पर पूर्ण अधिकार V4 Masters E Vyapari का होगा।

Vendor:

  • Platform की सामग्री की कॉपी नहीं करेगा;
  • बिना अनुमति लोगो का उपयोग नहीं करेगा;
  • मिलते-जुलते नाम, डोमेन या ट्रेडमार्क पंजीकृत नहीं करेगा;
  • Platform Software को Modify या Reverse Engineer नहीं करेगा;
  • Platform की बौद्धिक संपदा पर स्वामित्व का दावा नहीं करेगा।

अनधिकृत उपयोग की स्थिति में:

  • Account निलंबित किया जा सकता है;
  • कानूनी कार्रवाई की जा सकती है;
  • क्षतिपूर्ति का दावा किया जा सकता है;
  • सेवाएँ स्थायी रूप से समाप्त की जा सकती हैं।

10. Privacy & Data Usage

10. गोपनीयता एवं डेटा उपयोग

English

The Vendor agrees that:

  • Personal, business and KYC information may be collected and stored by the Platform.
  • Information may be shared with courier partners, payment gateways, banks, government authorities or service providers for service delivery and legal compliance.
  • The Platform may use cookies, logs and technical data for improving services and security.
  • The Platform shall take reasonable measures to protect Vendor data but does not guarantee absolute security.

The Vendor agrees to the collection, processing and storage of information in accordance with the Privacy Policy.

Vendor सहमत है कि:

  • Platform उसके व्यक्तिगत, व्यवसायिक एवं KYC संबंधी डेटा को एकत्र एवं संग्रहित कर सकता है।
  • सेवा प्रदान करने तथा कानूनी अनुपालन हेतु यह जानकारी Courier Partners, Payment Gateway, Banks, Government Authorities या Service Providers के साथ साझा की जा सकती है।
  • Platform सेवा सुधार एवं सुरक्षा के लिए Cookies, Logs एवं अन्य तकनीकी डेटा का उपयोग कर सकता है।
  • Platform डेटा की सुरक्षा के लिए उचित उपाय करेगा, परन्तु पूर्ण सुरक्षा की गारंटी नहीं देता।

Vendor Privacy Policy के अनुसार डेटा संग्रहण एवं उपयोग के लिए सहमति प्रदान करता है।

11. Suspension & Termination

11. निलंबन एवं समाप्ति

English

V4 Masters E Vyapari reserves the right to suspend, restrict or terminate any Vendor account without prior notice if:

  • False information is provided;
  • Outstanding dues remain unpaid;
  • Vendor violates these Terms;
  • Fraudulent or illegal activities are detected;
  • Prohibited shipments are booked;
  • Courier partner policies are violated;
  • Government or legal action requires suspension.

Upon termination:

  • Account access may be blocked;
  • Shipments may be withheld or cancelled;
  • Outstanding dues shall remain payable;
  • Vendor shall immediately cease use of the Platform.

यदि:

  • गलत जानकारी दी जाती है;
  • बकाया भुगतान नहीं किया जाता;
  • इन नियमों का उल्लंघन होता है;
  • धोखाधड़ी या अवैध गतिविधि पाई जाती है;
  • प्रतिबंधित शिपमेंट बुक की जाती है;
  • Courier Partner की नीतियों का उल्लंघन होता है;
  • सरकारी या कानूनी निर्देश प्राप्त होते हैं;

तो V4 Masters E Vyapari बिना पूर्व सूचना Vendor Account को निलंबित, सीमित या समाप्त कर सकता है।

समाप्ति की स्थिति में:

  • Account Access बंद की जा सकती है;
  • Shipments रोकी या रद्द की जा सकती हैं;
  • बकाया भुगतान देय रहेगा;
  • Vendor तुरंत Platform का उपयोग बंद करेगा।

12. Limitation of Liability

12. दायित्व की सीमा

English

The Platform acts only as a technology aggregator facilitating shipment booking through third-party courier partners.

V4 Masters E Vyapari shall not be liable for:

  • Courier delays;
  • Delivery failures;
  • Shipment loss or damage beyond approved claim limits;
  • Government restrictions;
  • Internet or technology failures;
  • Indirect or consequential losses;
  • Loss of business, profits or reputation.

Maximum liability of the Platform shall not exceed:

₹2,000 per shipment OR Actual Invoice Value, whichever is lower.

Claims shall be payable only after approval from the concerned courier partner and subject to applicable claim policies.

Platform केवल एक Technology Aggregator है जो तृतीय-पक्ष Courier Partners के माध्यम से Shipment Booking की सुविधा प्रदान करता है।

V4 Masters E Vyapari निम्न के लिए जिम्मेदार नहीं होगा:

  • Courier में देरी;
  • Delivery Failure;
  • अनुमोदित Claim सीमा से अधिक Shipment Loss या Damage;
  • सरकारी प्रतिबंध;
  • Internet या Technology Failure;
  • अप्रत्यक्ष या परिणामी हानि;
  • व्यापार, लाभ या प्रतिष्ठा की हानि।

Platform की अधिकतम जिम्मेदारी:

₹2,000 प्रति Shipment अथवा वास्तविक Invoice Value, जो भी कम हो, तक सीमित होगी।

Claim राशि संबंधित Courier Partner की स्वीकृति एवं लागू Claim Policy के अधीन होगी।

13. Force Majeure

13. अप्रत्याशित परिस्थितियाँ (Force Majeure)

English

Neither the Platform nor the Vendor shall be liable for delay or failure caused by events beyond reasonable control, including:

  • Floods;
  • Earthquakes;
  • Fire;
  • Pandemic or epidemic;
  • War or terrorism;
  • Government restrictions;
  • Internet or telecom failures;
  • Cyber-attacks;
  • Strikes;
  • Transportation disruptions;
  • Any other Force Majeure event.

During such events, services may be delayed, restricted or suspended without liability.

यदि निम्न कारणों से देरी या सेवा बाधित होती है:

  • बाढ़;
  • भूकंप;
  • आग;
  • महामारी;
  • युद्ध या आतंकवाद;
  • सरकारी प्रतिबंध;
  • Internet या Telecom Failure;
  • Cyber Attack;
  • हड़ताल;
  • परिवहन बाधा;
  • अन्य अप्रत्याशित परिस्थितियाँ;

तो Platform या Vendor किसी भी प्रकार के दायित्व के लिए उत्तरदायी नहीं होंगे।

ऐसी स्थिति में सेवाएँ अस्थायी रूप से रोकी या सीमित की जा सकती हैं।

14. Governing Law & Jurisdiction

14. लागू कानून एवं अधिकार क्षेत्र

These Terms & Conditions shall be governed by the laws of India.

All disputes arising out of or relating to the Platform shall be subject to the exclusive jurisdiction of competent courts located at:

Nadaun, District Hamirpur, Himachal Pradesh – 177033, India

ये नियम एवं शर्तें भारत के लागू कानूनों द्वारा नियंत्रित होंगी।

Platform से संबंधित सभी विवादों पर निम्न न्यायालयों का विशेष अधिकार क्षेत्र होगा:

15. Electronic Acceptance

15. इलेक्ट्रॉनिक स्वीकृति

By clicking "I Agree", ticking the checkbox, creating an account or using the services of ship.v4masters.com, the Vendor:

  • Confirms that he/she has read and understood these Terms & Conditions;
  • Agrees to be legally bound by all Platform Policies;
  • Accepts that electronic acceptance shall have the same legal effect as a physical signature.

हिंदी

"I Agree" बटन दबाने, Checkbox चुनने, Account बनाने या ship.v4masters.com की सेवाओं का उपयोग करने पर Vendor:

  • यह पुष्टि करता है कि उसने इन नियमों एवं शर्तों को पढ़ और समझ लिया है;
  • Platform की सभी नीतियों से कानूनी रूप से बंधे रहने के लिए सहमत है;
  • यह स्वीकार करता है कि इलेक्ट्रॉनिक स्वीकृति का वही कानूनी प्रभाव होगा जो भौतिक हस्ताक्षर का होता है।
